The Agreement

This Agreement is by and between Austrasoft Pty Ltd (ACN 089 086 813), hereinafter called suplier, and the Client, for the provision of certain electronic communications services in exchange for the payment of fees and compliance with conditions stated herein.

These terms form part of an agreement under which we agree to provide Internet access and related services for you. In these terms:

  • "we" or "Australink.net" means Austrasoft Pty Ltd trading as Australink dot net, providing Internet access and other Internet related services;
  • "the Client" means you, the person using our services or products.
  • "Service" means any goods or services of any kind forming part of our internet access and access-related services.
  • "System" refers to any computer, network, terminal, or device which is used to supply Australink.net services.

First use of the Services shall constitute acceptance of this Agreement ("Agreement").

 
Billing, Terms, Termination & Suspension

By accessing the 'system', the Client agrees to the following:

  • By supplying credit card details on the electronic or physical application form, by telephone or by means of e-mail, the Client agrees that;

    *For Example: If the client has paid two months in advance on the day of signing up for service, he will be billed monthly. If the client has elected to pay six months or 12 months in advance, he will be billed for six or 12 months on the date due.

    • Australink will deduct payments on a regular basis and without notice, for network services provided, data charges, account administration fees including various late payment penalties, excess time or data used and any other charges related to providing services to the Client.
    • The Client agrees to pay a connection (tech support) fee, and advance payments as required, in accordance with the plan chosen and that Australink dot net will hold one month payment in reserve until cancellation of service. The Client further agrees that all services provided are prepaid services ( PAYG excepted ) and the subsequent dues will be charged on the first (1st) of the month according to the plan and method selected *.
    • The client further agrees to pay all dues on or before the due date, else the service will be suspended until the account is brought back within agreed upon standard.
    • The Late Payment Fee of $22.00 will be charged before the account is activated again.
    • Invoices are sent electronically via E-mail. If a hard copy is requested, it will incur an additional charge of $7.50 for a faxed copy and $11.00 if mailed. (GST Included)
    • The client understands that from time to time there will be additional information sent besides invoices. This action should not be viewed as spamming for as long as he is a client.
    • The client will not issue a charge back on any deductions or payment made by a Credit Card. If issued, it will be considered a fraudulent transaction and we'll take steps for recovery. Additional $44 will be charged to cover the cost of recovery.
 
Trading Terms

The Client in signing this agreement agrees not to attempt to gain access to private or restricted information. This information is defined as any information stored on the AUSTRALINK.NET systems which is not contained within their own user account and includes access to the non-public areas of the AUSTRALINK.NET network including but not limited to, routers and internal file servers.

Australink reserves the right to disconnect the service at any time for breach of this condition.

Account holder may check his/her monthly account usage and appropriate charges under the check time, located in the member area. If The Client wishes to be disconnected from the system, advice must be forwarded by fax, Post or E-mail to Australink dot net, at least seven (7) days prior to the next billing period as no monies are refundable. No cancellations will be accepted by telephone.

To select a different connection plan, the Client must notify the administrator seven (7) days prior to the next billing period. Change will take effect on the beginning of the next billing period. There are no charges for this service unless it is required outside this terms in which case a fee of $22 will apply, or $80 for ADSL changes.

 
Warranties

With respect to services provided, the Australink dot net makes no warranties of any kind, whether expressed or implied, including any implied warranty or merchantability or fitness of this service for a particular purpose. The Australink dot net takes no responsibility for any damages suffered by the Client, including but not limited to, loss of data from delays, non-deliveries, misdeliveries, or service interruptions caused by the AUSTRALINK.NET own negligence outside influence or Client's errors and/or omissions. Any liability of the Australink dot net will be limited to resupply of the service. (This does not apply to our promise of income and earnings if the Client is interested in making money. This promise is guaranteed if instructions are followed.)

This service may only be used for lawful purposes. Materials and/or transmission in violation of any State or Federal regulation(s) is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret. The Client agrees to indemnify and hold harmless the Australink.net from any claims resulting from the Client's use of this service which damages Client or any third party.

 
Limitation of Liability

Use of any information obtained via this service is at the Client's risk. Australink.net specifically denies any responsibility for the accuracy or quality of information received or sent through its services.

 
Conditions
  1. The account entitles the Client to unlimited email boxes, and access to other standard internet services.
  2. Australink is dependent on external network and data services, therefore the user indemnifies Australink.net for any inability to provide such services which are beyond the control of Australink.net systems.
  3. Australink does not guarantee that access to any system either internal or external to Australink will be available at any given time or that the files and information or service will be error free or fault free.
  4. All Clients are entitled to unlimited MB download per month and subject to allocation according to the plan chosen.
 
Appropriate Use

Australink.net or other relevant authorities may determine inappropriate usage of this account and the privilege may be revoked at the AUSTRALINK.NET discretion. Should this occur, the Client will be informed in writing of this action, or other manner deemed necessary.

 
Changes To Terms and Conditions

The Australink dot net reserves the right to change the terms and conditions notifying the Client in writing or by electronic mail at least ten (10) working days in advance of the effective date of change. Changes will also be posted on the Australink dot net web site and will constitute the most current version, superseding any other electronic or hard copies. Use by the Client after the effective date constitutes acceptance of the new terms and conditions. If the Client does not agree to the new terms and conditions, the Client may terminate this agreement in accordance with the provisions stated above.

 
Records Management

Australink may monitor or keep any records of the Client's use of the service that may be deemed necessary.

 
Notices

All notices given by any party or required under this agreement shall be in writing (unless otherwise specified by Australink dot net) and addressed to the relevant party (ie) at the AUSTRALINK.NET business address as listed on this site or faxed to (07) 3219 5484

 
The Client Services

All services to be provided by the Client either in part or in total through the Australink network must be appropriate subject to relevant State and Federal regulations. The Australink dot net accepts no responsibility for their authorisation. Reselling of the AUSTRALINK.NET services is expressly encouraged.

 

We hold NO responsibility of unexpected toll call charge on Australink.net Dial-in Number 0198 333 072. It is the Client's sole responsibility to ensure the above number is a local call from the Client's calling location by calling Telstra on 1800 113 001.

Modem speeds below 14,400 are not supported.
